16 023 Cheshire Councils Enterprise Resource Planning (ERP) Solution.
Cheshire East Borough Council and Cheshire West and Chester Council (The Authorities) have undertaken a Competitive Dialogue procedure to procure a framework agreement for the design, build and implementation of an integrated enterprise resource planning (ERP) solution and the provision of ongoing support and maintenance. The core services impacted are Finance, Procurement, Human Resources and Payroll. The Framework Agreement will commence on 22.9.2017 for a period of 4 years. Individual call off contracts awarded under the Framework Agreement is for an initial term of 7 years with the option to extend for a further period(s) up to a maximum extension of 5 years. Both Authorities entered into a call off contract under the Framework on the same day as the award. In addition to the Authorities, Warrington Borough Council, Wirral Metropolitan Borough Council, Trafford Metropolitan Borough Council and Stockport Metropolitan Borough Council are entitled, but not obliged, to call off services.
The 4 Year Framework Agreement is awarded to a single supplier which was entered into by Cheshire East Council. The call-off contracts under the Framework Agreement are for an initial term of 7 years with the option to extend for 1 or more periods of up to 5 years. The value of the Framework Agreement is estimated to be approximately 42-50 000 000 GBP but will be dependent on the Authorities and Related Councils" decision whether to use the Framework Agreement. Owing to the size/nature of the services and help to ensure the best service continuity, the Authorities have decided not to subdivide the contract services into Lots. The scope includes the implementation of modules offering improved functionality and solution refreshes during the term.
No guarantee or warranty has been given as to the nature or volume of the Services or the number of call offs under the Framework Agreement.
As part of the procurement there were various optional services that the Councils can call-off as part of the Framework agreement.
The values given in this notice are only estimations and are for the initial 7 year contract period and also take into account the extension option of up to a further 60 months.
The Authority gives no guarantee or warranty or makes any representation as to the accuracy of any indicative volumes or as to the value of the work during the contract period.

Unit4 Business Software Limited provide the Enterprise Resource Planning (ERP) Solution) as part of the Framework Agreement with Agilisys Ltd.
Cheshire East Borough Council incorporated a standstill period at the point information on the award of the contract was communicated to tenderers. That notification provided full information on the award decision. The standstill period, which was for a minimum of 10 calendar days provided time for unsuccessful tenderers to challenge the award decision before the contract was entered into. The Public Contracts Regulations, 2015 (SINo 102) provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
